Terms & Conditions

These Terms govern your use of brokenbowescapes.com (the "Site") and any bookings you make through it. The Site is operated by Justin Whitaker, a sole proprietor doing business as Broken Bow Escapes ("we", "us", "our"), based in Broken Bow, Oklahoma, USA.

By accessing, browsing, or booking through the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site. You confirm that you are at least 18 years old and have the legal capacity to enter into a binding contract. If you are booking on behalf of a group, you represent that you have authority to bind every guest in your party to these Terms.

We list, market, and accept reservations for two short-term rental cabins in Broken Bow, Oklahoma — Sound of Sunshine and As Good As It Gets — along with optional add-ons (chef services, early check-in, etc.). We do not guarantee that the Site will be uninterrupted, error-free, or that listings, prices, and availability shown will always be current. We may update, suspend, or withdraw any part of the Site at any time.

You must not:

• use the Site for any unlawful, fraudulent, or harmful purpose;
• submit false booking information, chargeback in bad faith, or impersonate another person;
• infringe our or any third party's intellectual property rights;
• scrape, crawl, or harvest content except as permitted by our robots.txt;
• upload malware, probe or test the vulnerability of the Site, or interfere with its security or operation.

The Site and all content on it — including text, photography, cabin names, brand marks, and the Broken Bow Escapes name and logo — are owned by Justin Whitaker or our licensors and are protected by US and international copyright and trademark law. You receive a limited, non-exclusive, non-transferable right to view the Site for the purpose of planning and managing a stay. No other rights are granted.

Bookings are accepted subject to availability. A 50% deposit is charged at booking; the remaining balance is due 14 days before check-in via a payment link emailed to you. All amounts are in US dollars.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. The full payment, billing, and tax terms that apply to your purchase are set out in Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms.

Refunds are governed by our Refund Policy, which forms part of these Terms.

While at the property you agree to: respect the maximum occupancy stated on the listing, not host events or parties without prior written consent, not smoke indoors, supervise children and pets at all times, and leave the property in the condition in which you found it. We may charge for damage, excessive cleaning, or violation of these rules.

We may suspend or terminate your access to the Site, cancel a pending booking, or refuse a future booking if you: materially breach these Terms; fail to pay an amount owed; pose a security or fraud risk; or repeatedly or seriously violate our stay rules or applicable law. Where lawful and reasonable we will tell you why.

Except where prohibited by law, the Site and our cabins are provided on an "as is" basis and we disclaim all implied warranties including merchantability and fitness for a particular purpose. To the maximum extent permitted by law, our aggregate liability arising out of or relating to your use of the Site or a booking will not exceed the total amount you paid us for that booking. We are not liable for indirect, incidental, consequential, or special damages, including lost profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence where that exclusion is prohibited by law.

You agree to indemnify and hold harmless Justin Whitaker and Broken Bow Escapes from any third-party claims arising out of your unlawful use of the Site, your violation of these Terms, or damage you cause at the property.

These Terms are governed by the laws of the State of Oklahoma, USA, without regard to conflict-of-law principles. The state and federal courts located in McCurtain County, Oklahoma will have exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction.

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Continued use of the Site after an update means you accept the revised Terms.
